Small Animal Pet Sitting and Pet Taxi Services Policy
This Services Policy (the “Agreement”) is made as of this date by and between the attached client (the “Pet Guardian”) and
A Peaceful Pet
/
PetProductDelivery.com
(the “Pet Sitter” / "Pet Taxi Driver"), (each, a “Party” and collectively, the “Parties”).
Pet Sitter / Pet Taxi Driver shall care for Pet Guardian's pet(s) as identified and described in the scheduled visit. In consideration for Pet Sitter / Pet Taxi Driver's care and services, Pet Guardian shall pay Pet Sitter / Pet Taxi Driver according to the invoice. The payment is due to Pet Sitter / Pet Taxi Driver by the date of the last day visit services are rendered and paid via online invoice less deposit, if any. Pet Guardian agrees to reimburse Pet Sitter / Pet Taxi Driver for reasonable expenses incurred arising from/relating to care paid via online invoice.
Care and Services.
The care and services provided under this Agreement may consist of pet sitting and/or pet transportation.
In addition, Pet Guardian authorizes Pet Sitter / Pet Taxi Driver to seek and obtain medical attention and treatment as deemed necessary by a veterinarian.
Injury and Indemnification.
If Pet Guardian's pet(s) accidentally dies, becomes ill, injured, or lost, Pet Guardian waives and releases Pet Sitter / Pet Taxi Driver from any claim arising from such an incident. If Pet Guardian's pet(s) bites or injures Pet Sitter / Pet Taxi Driver, any other human or animal, Pet Guardian will be responsible for any resulting injury and shall hold harmless and indemnify Pet Sitter / Pet Taxi Driver from any claim or suit that may be brought as a result of such an incident. In addition, Pet Guardian shall hold harmless and indemnify Pet Sitter / Pet Taxi Driver against any and all costs, expenses, losses, liabilities and claims arising out of or relating to any acts of Pet Owner's pet(s) except for negligence or intentional misconduct on the part of the Pet Sitter / Pet Taxi Driver.
Governing Law.
The terms of this Agreement shall be governed by and construed in accordance with the laws of the State of Texas, not including its conflicts of law provisions.
Severability.
If any provision of this Agreement is held to be invalid or unenforceable in whole or in part, the remaining provisions shall not be affected and shall continue to be valid and enforceable as though the invalid or unenforceable parts had not been included in this Agreement.
This Agreement contains the entire understanding between the Parties and supersedes and cancels all prior agreements of the Parties. This Agreement may be amended or modified only by a written agreement signed by all the Parties.
